Lawsuit brought by union aims to defund type 2 public charter schools, decision could come WednesdayNEW ORLEANS – Louisiana parents and students are watching closely for a decision from the Louisiana Supreme Court, which many expect will come tomorrow, in the case of Iberville Parish School Board, et al v. Louisiana State Elementary and Secondary Education Board, et al. The lawsuit, brought by the union, attempts to defund Type 2 public charter schools serving about 16,000 Louisiana students. If the union is successful, those students would likely be kicked out of the schools they currently choose. The district court, in May of 2015, established that charter schools are public schools and the current funding mechanism established by the state can continue. Despite the district court’s ruling, the union pushed forward with an appeal. In January of 2017 the appeals court sided with the union, triggering an appeal to the supreme court. The supreme court heard arguments in September of last year. With multiple opinion releases since the hearing, many expect a decision on Wednesday, the next scheduled release of opinions. Data submitted in an amicus brief from PublicSchoolOptions.org and two Louisiana parents showed that if the union is successful in defunding these public schools, on average, 75 percent of Type 2 public charter school students would be forced to return to lower-performing district schools than the Type 2 public charter schools they currently attend. The union filed a motion with the Louisiana Supreme Court to not allow the data into the record but was unsuccessful. We hope the court will reverse the appellate court’s decision and affirm the rights of parents to choose the educational option that works for their children.
